Updating the ITC Handbook on WTO Accession for Developing Countries
TULIP updated the International Trade Centre’s (ITC) comprehensive handbook on WTO accession negotiations for developing countries, a reference resource used by government officials, trade negotiators, and legal practitioners engaged in or preparing for WTO accession processes. The update handbook reflected the significant evolution of the WTO’s accession landscape and the substantive changes to the multilateral trading system that had occurred since the handbook’s previous edition.
WTO accession is a complex, lengthy, and resource-intensive process that requires acceding governments to negotiate with existing members on a wide range of trade policy commitments, covering goods, services, intellectual property, trade facilitation, and an expanding range of other areas. For developing countries and least developed countries (LDCs), the accession process presents particular challenges, including limited negotiating capacity, the need to balance WTO commitments with domestic development priorities, and the risk of accepting commitments that constrain future policy space for industrial and agricultural development.
TULIP’s update to the handbook incorporated developments across several areas. On the substantive side, the revision addressed the growing importance of sustainability-related commitments in accession negotiations, reflecting the increasing tendency of WTO members to seek commitments from acceding governments on environmental regulation, carbon pricing, and green trade measures. The update also addressed developments in digital trade and e-commerce, an area that has grown significantly in importance for accession negotiations as WTO members have advanced discussions on a potential plurilateral e-commerce agreement.
The handbook also incorporated updated analysis of Special and Differential Treatment (SDT) provisions available to developing countries and LDCs in accession negotiations, including the application of the Guidelines on Accession of LDCs and the principles that should govern the terms of accession for economies at different levels of development. This included an assessment of how SDT provisions have been applied in recent accession processes and the extent to which they have provided meaningful flexibility for acceding developing country governments.
The updated handbook also provided guidance on procedural aspects of the accession process, including how to structure working party negotiations, engage with key trading partners, and manage the technical and institutional demands of the process. It drew on lessons from recent accession processes to offer practical advice for governments preparing to engage with the WTO accession process.
